Terms of Service
General Terms of Use under Italian Legislative Decree 206/2005 (Consumer Code)
and Legislative Decree 70/2003 (E-commerce)

1. Definitions
For the purposes of these Terms:
- "Service" or "Platform": the website and web application "Fiabary", available at https://fiabary.app, including all features offered.
- "Owner" or "Operator": Covency Srls, owner of the Service and controller of personal data.
- "User": any adult natural person who registers for the Service.
- "Guest": a natural person invited by the User to access the shared diary in read-only mode.
- "Free Plan": the free access level made available by the Service.
- "Paid Plans": the paid subscription levels made available by the Service, with prices, limits and features shown in the pricing table and during checkout.
- "Content": texts, images, audio, generated stories and any other material uploaded or produced by the User through the Service.
- "Minor": the child whose data and memories are entered in the diary by the User.
2. Acceptance of the Terms
Registration for the Service and use of its features imply full and unconditional acceptance of these Terms of Service and of the Privacy Policy.
The Service is reserved for adults aged 18 or over acting as parents or legal guardians of the minors whose data is processed. By registering, the User declares, under their own responsibility, that they meet these requirements.
3. Description of the Service
"Fiabary" is a digital platform that allows parents and legal guardians to:
- Collect and organize memories, phrases, photographs, drawings and voice notes about their children.
- Obtain automatic narrative processing (magical stories) based on the content entered.
- Automatically transcribe voice notes into text.
- Generate illustrations and custom avatars for the child profile.
- View content in a chronological timeline organized by the child's age.
- Selectively share the diary with family members or trusted people.
- Generate complete narrative collections from recorded moments (Big Book).
- Export content as PDF or ebook where included in the active plan.
- Order a physical on-demand printed book through the integrated print flow, paid separately from the subscription.
The Owner may modify, suspend or discontinue Service features with reasonable notice, except in urgent cases or force majeure.
4. User Obligations and Responsibilities
4.1 Account
- The User is responsible for keeping login credentials secure and for all activity carried out through their account.
- Sharing credentials with unauthorized third parties is prohibited.
- Suspected unauthorized access must be reported immediately to the Owner.
- Only one account per natural person is allowed.
4.2 Uploaded Content
The User undertakes to:
- Upload only content they own or for which they have obtained the consent of the rights holders.
- Not upload unlawful, offensive, pornographic, violent or dignity-harming content.
- Not upload personal data of people other than the minor for whom they hold parental responsibility, unless consent has been obtained.
- Not use the Service for commercial, advertising or non-personal/non-family purposes.
4.3 Parental Responsibility for the Minor's Data
4.4 Moderation of Multimedia Content
Each image or drawing uploaded by the User is subject to automatic AI-based moderation. Content that violates these policies is blocked before storage. Ambiguous content may be flagged for manual review by platform administrators.
Strictly prohibited content, subject to immediate removal and reporting to the authorities:
- Child sexual abuse material or sexually explicit material involving minors, in any form.
- Images depicting physical or psychological abuse or violence against minors.
- Any content whose possession or distribution is a criminal offence under Italian or EU law.
The Owner reserves the right to immediately report any such content to the competent authorities, including the User's identifying data within the limits allowed by law.
Moderation does not constitute systematic verification of all content and does not guarantee that all inappropriate content will be absent. The User remains primarily responsible for what they upload.
4-bis. Guests: Shared Diary Access
The User may invite trusted people ("Guests") to access shared diary content in read-only mode. Guest access is limited to content explicitly shared by the User and does not include editing, uploading, exporting or deleting data.
- Guests must treat viewed content as confidential and must not disclose it without the sharing User's consent.
- Guests may not download, copy or systematically reproduce shared diary content outside the Service.
- By accessing the shared diary, Guests accept these Terms to the extent applicable to their read-only role.
The User may revoke Guest access at any time from the "Family" section of the dashboard. Revocation is immediate. The Owner may revoke access if these Terms are breached.
5. Subscription Plans and Payments
5.1 Free Plan
The Free Plan is available without time limits and at no cost. It includes the basic features shown in the current pricing table and in the User's dashboard. The Owner may change the features included in the Free Plan with 30 days' notice.
5.2 Paid Plans
The Service may offer one or more Paid Plans with different prices, billing periods, usage limits and included features. The applicable commercial conditions are those shown in the pricing table and during checkout before purchase or renewal.
Payment is made by credit or debit card through Stripe, Inc. Paid Plans renew automatically according to the billing period selected by the User until cancellation.
5.3 Withdrawal and Refunds
Right of withdrawal
Consumers may withdraw from a paid subscription within 14 days of purchase, without giving any reason, by writing to info@covency.it.
If the User expressly requested immediate performance of the Service during the withdrawal period, any refund will be proportional to the days of service actually used.
5.4 Failed Payment and Downgrade
If a Paid Plan is not renewed or is cancelled, the account automatically returns to the Free Plan. Existing content remains stored and accessible, subject to the limits of the Free Plan; paid-only features become unavailable until reactivation.
5.5 Promotional Codes
The Owner may issue promotional codes granting discounts or free access periods to one or more Paid Plans. Codes are personal, non-transferable, non-cumulative unless stated otherwise, and may expire. Misuse or counterfeiting of promotional codes may lead to revocation of the benefit and account suspension.
5.6 AI Feature Usage Limits
Automated processing features (story generation, voice transcription, avatar generation) are subject to usage limits depending on the active plan. Updated limits are shown in the dashboard and may be changed by the Owner with 30 days' notice. Exceeding limits temporarily suspends the relevant feature until the reference period renews, without additional charges.
5-bis. Physical Book Printing
Print Service Description
The Service allows Users to order a physical on-demand printed book through an appointed print partner based in the USA. Printing is optional, paid separately from any subscription, and subject to the prices shown at the time of order. Production and shipping are handled by the print partner; delivery times depend on the shipping method and destination.
Exclusion of Withdrawal Right
Important - Art. 59(c) of Italian Legislative Decree 206/2005
The physical book is a made-to-order and clearly personalized item based on the User's specific content. Under Art. 59(c) of the Italian Consumer Code, the right of withdrawal does not apply to print orders once production has started. The User should carefully check the preview before confirming the order.
Defects and Non-Conformity
In case of printing defects or damage attributable to the production process, the User may request replacement or refund by contacting support within 30 days of receipt. Statutory conformity guarantees under the Consumer Code remain applicable.
6. Intellectual Property
The User keeps ownership of all rights in original content uploaded by them. Uploading content grants the Owner a limited, non-exclusive and non-transferable license solely to provide the Service.
Automatically generated stories based on User content are made available for personal and family use. The Owner does not claim exclusive rights over such outputs.
Source code, design, trademarks, logos and all other Platform elements are the exclusive property of the Owner and may not be reproduced, modified or distributed without written authorization.
7. Limitation of Liability
To the extent permitted by applicable law, the Owner is not liable for:
- Data loss caused by events outside the Owner's reasonable control.
- Temporary Service interruptions due to ordinary or extraordinary maintenance.
- Quality, accuracy or suitability of automatically generated stories.
- User content uploaded in breach of these Terms.
- Improper use of credentials by unauthorized third parties.
The Owner undertakes to ensure maximum Service continuity and periodic data backups. If data loss is attributable to the Owner's negligence, liability is limited to the subscription fees paid in the last 12 months.
8. Account Suspension and Deletion
The User may delete their account at any time from the Profile section of the dashboard. Deletion results in removal of associated data within 30 days, except where legal retention obligations apply.
The Owner may suspend or delete an account in case of serious or repeated breach of these Terms, unlawful content upload, fraudulent use or violation of law. If criminal material is detected, the Owner will delete the account and related content immediately and may report the matter to the competent authorities as permitted by law.
9. Changes to the Terms of Service
The Owner may modify these Terms at any time. Substantial changes will be communicated to registered users by email with at least 15 days' notice. Continued use of the Service after the changes take effect constitutes acceptance of the new terms.
10. Governing Law and Jurisdiction
These Terms are governed by Italian law. For any dispute relating to interpretation, performance or termination of these Terms, the parties agree to first attempt an amicable resolution within 30 days from notification of the dispute.
For consumers, the competent court is the court of the consumer's place of residence or elected domicile. For business relationships, the exclusive forum is Piazza Giacomo Matteotti, 52 - Modena.
Users may also use the European ODR platform at ec.europa.eu/consumers/odr.
